By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given me your consent to allow any of your minor dependents to use this site.
You may not use my products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
You must not transmit any worms or viruses or any code of a destructive nature.
A breach or violation of any of the Terms will result in an immediate termination of your Services. 

GENERAL CONDITIONS

I reserve the right to refuse service to anyone for any reason at any time. You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by me. The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

CREATING AN ACCOUNT/ NEWSLETTER SUBSCRIPTION

To make a purchase on my website you are not required to register. You can proceed to checkout as a visitor should you not wish to open an account. However, to be able to use some of the services and features or to be notified of any promotional offers, discounts and/or special events, you may need to create an account or subscribe to my newsletter. You do not need to create an account to subscribe to my newsletter, but can opt to do so once you have created an account and have signed in or while purchasing an item. When you register, you are required to provide information about yourself that is true, accurate, current and complete in all respects. The account password you provide should be unique and kept secure. You must notify info@danielaparadeis.com immediately of any breaches in security or unauthorised use of your account. Should any of your registration information change, you can sign in to your account by clicking on the ‘Log in’ button on the right hand corner of the home page (right next to your cart) and update/edit your personal information, billing and shipping address(s). I may change account requirements from time to time so please check for updates on a regular basis.

ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION

I am not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk. This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. I reserve the right to modify the contents of this site at any time, but I have no obligation to update any information on my site. You agree that it is your responsibility to monitor changes to my site.

PRICES

All prices listed are in EURO.  Daniela Paradeis Lingerie Manufaktur e.U. is an individual enterprise, exempted from VAT, due to the small business law, as defined in §19 UstG. The prices of the goods will be as quoted on the website when you confirm your order (when you ‘checkout’) subject to inadvertent technical errors that I will not be liable for. If you later amend your order, the prices charged will be those applicable to the items at the time that the amended order is confirmed.  Please note that as promotions are offered for limited periods of time, subsequent amendments to your order may mean that certain promotions are no longer offered. Prices of goods do not include any delivery charges.

MODIFICATIONS TO THE SERVICE AND PRICES

Prices for my products are subject to change without notice. I reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. I shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

PRODUCTS OR SERVICES

Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to my Return Policy. I have made every effort to display as accurately as possible the colors and images of my products that appear at the store. I cannot guarantee that your computer monitor's display of any color will be accurate. I reserve the right, but am not obligated, to limit the sales of my products or Services to any person, geographic region or jurisdiction. I may exercise this right on a case-by-case basis. I reserve the right to limit the quantities of any products or services that I offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of me. I reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited. I do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

ACCURACY OF BILLING AND ACCOUNT INFORMATION

I reserve the right to refuse any order you place with me. I may, in my sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that I make a change to or cancel an order, I may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. I reserve the right to limit or prohibit orders that, in my sole judgment, appear to be placed by dealers, resellers or distributors. You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that I can complete your transactions and contact you as needed. I may provide you with access to third-party tools over which I neither monitor nor have any control nor input. You acknowledge and agree that I provide access to such tools ”as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. CANCELLATIONS

If you change your mind about an order you have placed, please contact me as soon as possible via mail at info@danielaparadeis.com within 24 hours of your order including weekends, bank holidays and public holidays. No cancellations can be made after this time.

USER COMMENTS, FEEDBACK AND OTHER SUBMISSIONS

If, at my request, you send certain specific submissions (for example contest entries) or without a request from me you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, 'comments'), you agree that I may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to me. Where possible, I take every care to ensure that the description, compositions and images of my products are correct. However, images, compositions and descriptions of products on my website are not intended to be binding and are intended only to give a general description of the products.
Please note, my products are all handmade therefore the products I send you may vary slightly from the images on my website and other similar products.

Prices are exclusive of VAT, due to the Austrian small business law, as defined in §19 UstG.. Delivery costs will be charged in addition. Prices and availability of products are subject to change without notice. Offers and special promotions are subject to availability.

Occasionally there may be information on my site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

TERMINATION

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
These Terms of Service are effective unless and until terminated by either you or me. You may terminate these Terms of Service at any time by notifying me that you no longer wish to use my Services, or when you cease using my site.

If in my sole judgment you fail, or I suspect that you have failed, to comply with any term or provision of these Terms of Service, I also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to my Services (or any part thereof). 

ENTIRE AGREEMENT

The failure of me to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
These Terms of Service and any policies or operating rules posted by me on this site or in respect to The Service constitutes the entire agreement and understanding between you and me and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and me (including, but not limited to, any prior versions of the Terms of Service).

Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

FAIR USE OF INTELLECTUAL PROPERTY

Material from this website may not be re-used without written permission. All content, pictures, photographs and copy are the property of Daniela Paradeis Lingerie Manufaktur e. U.. I reserve my legal rights to take such steps as necessary to protect my customers and intellectual property. Vigorous legal action will be taken against any infringement of this copyright.

FORCE MAJEURE

If either party is subject to an event of Force Majeure, that is circumstances outside its reasonable control, including but not limited to war, fire, industrial disputes or civil commotion, it shall notify the other and the first party’s obligations under these Terms shall be suspended until it notifies the other party of the end of such event of Force Majeure.

GOVERNING LAW

These Terms of Service and any separate agreements whereby I provide you services shall be governed by and construed in accordance with the laws of Handelsgericht Wien.

INTERNATIONAL CUSTOMERS

If products are being ordered from outside Daniela Paradeis’ country of residence, import duties and taxes may be incurred once your goods reach their destination. I am not responsible for these charges and I undertake to make no calculations or estimates in this regard.  If you are buying internationally, you are advised to contact your local customs authorities for further details on costs and procedures.  As the purchaser of the products, you will also be the importer of record and as such should ensure that your purchase is in full compliance with the laws of the country into which the goods are being imported.  Please be aware that goods may be inspected on arrival for customs purposes and I cannot guarantee that the packaging will be free of signs of tampering.

DELIVERY

Any dates specified by Daniela Paradeis for delivery of your order are intended to be an estimate only. If no date is specified, delivery shall be within a reasonable time. Subject to the other provisions of these terms, I shall not be liable for any loss, whether direct or consequential, economic or loss of profits or otherwise, arising directly or indirectly out of any delay in the delivery of the goods nor will any delay entitle the buyer to terminate or rescind the contract unless the delay exceeds 60 days.

RETURNS

All goods returned to Daniela Paradeis, whether incorrectly supplied, unwanted, damaged, or faulty, will only be accepted if they are within warranty. Goods must be returned complete, including all packaging, unworn and in an acceptable condition. I will aim to refund unwanted items within 14 days from the receipt of the returned goods. Should you wish to return an item for refund or exchange you should notify me within 7 days after the day on which delivery was made. After this 7 day period I can offer exchanges on products up to 30 days after purchase. Please note that the cost of sending it back must be met by you, the customer.
